Terms of Service

1. Overview

Nexcord ("the Service") is a Discord community management platform accessible at nexcord.app. It is owned and operated by Aoun Abu Hassan as an individual. Payments are processed by Paddle as merchant of record under an individual account.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old and hold a valid Discord account to use Nexcord. By using the Service, you confirm you meet these requirements.

3. The Service

Nexcord provides Discord community management tools including transcript generation, automated archiving, AI summarization, member verification, moderation tools, Role Manager, AutoMod, rate limit enforcement, and a web dashboard.

4. Acceptable Use

You agree not to:

  • Use the Service to store or distribute illegal content
  • Archive messages from servers where you do not have permission to do so
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Create accounts for the purpose of abuse or spam
  • Violate Discord's Terms of Service while using Nexcord
  • Resell or sublicense access to the Service without permission

5. AI Features

Some features use AI to provide summarization and content analysis. By using these features you acknowledge:

  • AI-generated outputs are for informational purposes only and may not be accurate, complete, or reliable
  • AutoMod actions (warn, mute, kick, ban) are executed automatically based on your configuration — server administrators are responsible for setting appropriate thresholds and reviewing flagged content
  • AutoMod Rate Limit actions are executed automatically based on configured escalation steps — server administrators are responsible for configuration
  • You must not use AI features for unlawful, harmful, or abusive purposes including spam, harassment, fraud, or system manipulation
  • You are solely responsible for content generated through your use of AI features and for compliance with applicable laws and Discord's Terms of Service
  • We reserve the right to enforce usage limits, modify quotas, or suspend access to AI features at any time
  • We are not liable for any outcomes resulting from AI-generated content or automated actions

6. Admin Access & Monitoring

Nexcord maintains an internal admin panel used by authorised staff to monitor service health, investigate abuse, and manage records. By using the Service you acknowledge:

  • Nexcord staff may access your account information, server data, and usage logs for abuse prevention, debugging, and service integrity
  • Automated systems may flag your account or server if usage patterns trigger abuse thresholds — flagged accounts may be reviewed and may result in suspension or termination
  • All admin panel actions are logged in an audit trail
  • This access is not used for advertising and is not sold to third parties

7. Server Administrator Responsibilities

Message Logging & AutoMod:
You must run /notice and maintain an active notice in your server before enabling message logging or AutoMod. You are responsible for complying with applicable privacy laws in your jurisdiction. These features will not function without an active notice — if the notice message is deleted, they stop automatically.

Verification:
You are responsible for ensuring your verification configuration complies with applicable laws. You must not use verification data to discriminate against users based on protected characteristics.

Transcripts:
You are responsible for ensuring you have the right to archive messages in the channels you transcript. You must not use transcripts to violate Discord's Terms of Service or applicable laws.

Welcome & Leave Messages:
You are responsible for channel configuration and ensuring the bot has appropriate permissions.

8. Your Content

You retain ownership of messages and content stored in your transcripts. By using Nexcord, you grant us a limited license to store, process, and display this content solely to provide the Service. You are responsible for ensuring you have the right to transcript channels and messages.

9. Message Logging & AutoMod

The message logging and AutoMod features (Pro only) allow server administrators to log and analyze messages in configured channels. By enabling either feature you acknowledge:

  • You have posted the required /notice in your server
  • Your server members have been informed of data collection and automated moderation
  • You will comply with applicable data protection laws
  • Nexcord is a data processor acting on your instructions as data controller
  • You are solely responsible for the lawfulness of collecting and processing your members' messages

10. Subscriptions & Billing

Pro subscriptions are billed through Paddle as merchant of record under an individual account. By subscribing you agree to Paddle's terms in addition to these terms.

Subscriptions auto-renew until cancelled. You may cancel at any time through your dashboard — cancellation takes effect at the end of the current billing period with no prorated refunds for partial periods.

The 14-day free trial is available once per server. Attempting to circumvent this limit may result in account suspension.

We reserve the right to change pricing with reasonable notice to active subscribers.

11. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for losses resulting from downtime, data loss, or technical failures. The Service is provided "as is" and "as available" without warranties of any kind. We may modify or discontinue features with reasonable notice.

12. Termination

We may suspend or terminate accounts that violate these terms. You may delete your account at any time by contacting us. Upon termination, your data will be deleted within 30 days unless legal obligations require longer retention.

13. Limitation of Liability

To the maximum extent permitted by law, Nexcord and its owner are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

14. Governing Law

These terms are governed by the laws of England and Wales. This applies regardless of where you are located or the current ownership structure of Nexcord. Nothing in this clause limits any mandatory consumer protection rights you may have under the laws of your own jurisdiction.

15. Changes

We may update these terms from time to time. Material changes will be communicated with at least 14 days' notice via email or dashboard notification. Continued use after the notice period constitutes acceptance.
